Rule 27
Conditions to review fees
- If there is any condition mentioned in the contract regarding the review of fees, the fee will be reviewed in the following cases -
(a) Every five years because the contract does not mention a fixed fee, but only mentions a specific method of determining the fee, (b) if the contract states that the permit holder will get a certain percentage of profit from the operation of the project, if the rate of such profit changes,
(c) If there is an agreement that the Nepal government will receive a certain royalty or profit from the project, if the government of Nepal wants to reduce the fee by not taking such royalty or profit or taking less,
(d) In case of extension of contract period,
(e) If the application given by the permittee is justified and the fee is reviewed by showing a specific reason,
(f) If the Ministry deems it necessary to revise the opening fee for any particular reason.
